How to read the list
Three things the court checks on a sworn form.
Who commissions it
A commissioner for taking affidavits: a lawyer, a licensed paralegal, a notary public or an appointed commissioner. Under O. Reg. 431/20 you and the commissioner can be in different places, on a video call, and the jurat says so.
Whether it prints the video jurat
30 forms, every Small Claims form among them, already print a jurat for commissioning by video. The others carry the ordinary jurat; the commissioner completes the modified jurat the regulation asks for. The court accepts both.
Who swears it
77 forms are sworn or declared by the person filing them. The 11 forms marked Confirm first are sworn by someone else, a process server, a witness, agency staff, or must be sworn in person; send us the form and we tell you before you book.

General guidance, not legal advice. “When you need it” is one sentence on the ordinary use of each form; your case may call for a different one. Forms change: the file to complete is the current one at ontariocourtforms.on.ca.
We are commissioners for taking affidavits and notaries public, not your lawyer: we take your oath or declaration and complete the jurat. What goes in the form is yours to decide, with legal advice where you need it.
