1. I declare that I ______ did not receive, or received and thereafter lost, cheque number ______ dated ______, in the amount of ______ $ ______ reportedly issued by the Family Responsibility Office drawn on the ROYAL BANK OF CANADA, Toronto, Ontario, with respect to Family Responsibility Office Case Number: ______
2. I additionally declare that I have not been paid this sum through any alternative means.
3. Should a replacement cheque be issued in my name, I undertake not to negotiate, endorse, or assign the original cheque if it comes into my hands, and to promptly return it to the Ministry of Community and Social Services, or the relevant successor entity.
4. I further undertake that if the Minister of Finance incurs any loss arising from the issuance of a replacement cheque, I will indemnify the Minister for all costs, damages, interest, and expenses resulting from any claim brought by me or my assignees, endorsees, or transferees on either the original or the replacement cheque, and I authorize the Minister of Finance to deduct the value of any such loss from any future payments owing to me.
5. To the best of my knowledge, information, and belief, the original cheque has not been cashed and has not been deposited into any account held by me.

The Family Responsibility Office (FRO) is the Ontario agency that collects and distributes court-ordered support payments. When a support payment cheque issued by the FRO is lost, stolen, destroyed, or never arrives, the recipient must swear a formal affidavit before the FRO will cancel the original and issue a replacement.
The affidavit is a short, factual document. You state your name, your FRO case number, the cheque number, the payment amount, and the fact that you did not receive or have lost the cheque. Because you are swearing under oath, the statement carries the same legal weight as testimony in court.
You need this affidavit any time an FRO payment cheque does not reach you or goes missing after delivery. The FRO cannot simply reissue the cheque on request because it must ensure the original is not cashed twice. Your sworn statement is the administrative safeguard that protects both you and the payor.
Gather the following details before your appointment. If you never received the cheque and do not have the cheque number, contact the FRO directly; they can provide it from their records.
Bring the completed affidavit and valid government-issued photo ID (Ontario driver's licence, Canadian passport, Ontario Photo Card, or Permanent Resident card) to a notary public or commissioner for taking affidavits. You will sign in front of the commissioner, who administers the oath and completes the jurat. Notarization at Minute Notary is a flat $19.90 per stamp.
Under O. Reg. 431/20, commissioning can also be done by live video if both you and the commissioner are located in Ontario.
Once the affidavit is sworn, submit the original to the FRO by mail or in person. The FRO will place a stop-payment on the original cheque and issue a replacement. Keep a photocopy of the sworn affidavit for your own records.
The FRO operates under the Family Responsibility and Support Arrears Enforcement Act, 1996 (S.O. 1996, c. 31). If you have questions about your case or payment schedule, contact the FRO directly.
Swearing a false affidavit is perjury under section 131 of the Criminal Code of Canada. It is an indictable offence carrying a maximum sentence of 14 years' imprisonment. The FRO may also refuse future replacement requests if a previous affidavit is found to be fraudulent. Only swear to facts you know to be true.
