  1. 01

What is a revocation of power of attorney?

It is a short signed document in which the grantor cancels a continuing power of attorney for property, a power of attorney for personal care, or both. It names the document being cancelled, its date and the attorney it appointed.

Once it is revoked, the attorney has no authority under that document. Under the Act, anyone who deals with the attorney in good faith without knowing of the revocation may still be protected, which is why notice matters.

  2. 02

    When you need one

You might revoke a power of attorney when:

    • You no longer trust the attorney, or your relationship has changed, such as after a separation.
    • The attorney has moved away, is ill or no longer wants the role.
    • You are replacing an old document and want no doubt about which one applies.
    • A bank or care home asks for written proof that an earlier power of attorney no longer applies.
  3. 03

    What to include

    Have these ready:

    • Your full name and address.
    • Which type of power of attorney you are revoking, and the date it was signed.
    • The full name of each attorney and any substitute it named.
    • Two eligible witnesses for the signing.
  4. 04

Official source and who accepts it

Under the Substitute Decisions Act, 1992, a continuing power of attorney for property ends when it is revoked, and the revocation must be in writing and executed the same way as the power itself (section 12). The same rule applies to a power of attorney for personal care (section 53).

Making a new power of attorney of the same type also ends the earlier one, unless the new document says you want more than one. A separate revocation removes any doubt, and banks often ask for one. Ontario's guide to powers of attorney is on ontario.ca.

  5. 05

    Common mistakes

    Avoid these:

    • Using a witness the Act disqualifies, such as the attorney's spouse or your own child.
    • Not telling the attorney. Until they know, they may keep acting, and people who deal with them in good faith may be protected.
    • Forgetting institutions that hold a copy: banks, investment firms, doctors, hospitals or a long-term care home.
    • Describing the old document vaguely. Give its type, its date and the attorney's name exactly.
  6. 06

How to have it witnessed in Ontario

Fill in the form on this page and print the PDF. Do not sign it yet: you sign on paper in front of two eligible witnesses, and each witness then signs. The rule on who may not witness is printed above the witness lines.

A notary public can be one of your two witnesses, in person only. Book an in-person mobile visit with Minute Notary anywhere in Ontario, and bring government-issued photo ID and your second witness. If no one you know can act as a witness, tell us when you book.

Frequently asked

Questions about the Revocation of Power of Attorney (Ontario)

01
Do I need witnesses to revoke a power of attorney?
Yes. A revocation under the Substitute Decisions Act, 1992 is signed the same way as the power it cancels, so you sign in front of two eligible witnesses, and each of them signs.
02
Who should get a copy?
The attorney and any substitute; your bank and any other institution that has a property power; and your doctor, hospital or care home for a personal care power. Keep the signed original yourself.
03
Can a notary witness it by video?
No. A notary witnesses in person. Ontario allows video witnessing of a power of attorney, or of its revocation, only when one witness is a lawyer or paralegal licensed by the Law Society of Ontario. Minute Notary offers in-person mobile visits anywhere in Ontario.
04
Does making a new power of attorney cancel the old one?
A new power of the same type ends the earlier one unless the new document says you intend to keep both. A written revocation is still the clearest proof for a bank or care provider.
05
Can I revoke if my capacity is in question?
You can revoke only while you are capable of making that type of power of attorney. If your capacity may be questioned, speak to a lawyer before you sign.
