  1. 01

    What is an affidavit for enforcement request?

    It is your sworn evidence that a judgment exists, that it has not been paid in full, and how much is still owing. The clerk relies on it to issue the process you ask for, so the figures must add up and match the court file.

    The court form lets you tick more than one process. This page prepares the one you choose; if you want more than one, tick each on the court form and add its details there.

  2. 02

    When you need one

    File Form 20P when the debtor has not paid and you want the clerk to issue:

    • a Certificate of Judgment (Form 20A), to enforce at another court location;
    • a Writ of Seizure and Sale of Personal Property (Form 20C) or of Land (Form 20D);
    • a Notice of Garnishment (Form 20E) or a Notice of Renewal of Garnishment (Form 20E.1);
    • a Notice of Examination (Form 20H), to question the debtor about their finances;
    • a Writ of Delivery (Form 20B), where the order was to hand over specific property.
  3. 03

    What to include

    Have the court file in front of you:

    • The claim number, the court location, and the creditor's and debtor's names.
    • The judgment date and the court location that made it.
    • The debt, pre-judgment interest, costs, payments received since judgment, post-judgment interest, later costs, and the total due.
    • For garnishment, the garnishee's name and address and why they owe the debtor money.
    • A separate sheet showing how you worked out the interest, which the court form asks you to attach.
  4. 04

    Official source and who accepts it

    The Small Claims Court accepts only its prescribed Form 20P. Download the current revision from Ontario Court Services, copy your prepared wording onto it, and swear it before a commissioner or notary. The form carries its own jurat for swearing in person or by video under O. Reg. 431/20.

    File the sworn affidavit with the court clerk, who issues the process when the request is complete.

  5. 05

    Common mistakes

    These are the usual reasons a request comes back:

    • Using the judgment amount without subtracting the payments received since.
    • Charging interest on the original judgment after partial payments; the form says interest runs on the amount owing from time to time.
    • Leaving out the separate interest calculation sheet.
    • Forgetting that a garnishment notice must reach the debtor within five days after the garnishee is served.

    How to get it notarized in Ontario

    Fill in the form on this page to prepare your wording, then copy it onto the official form. Do not sign it yet: an affidavit or statutory declaration is signed in front of a notary public or commissioner for taking affidavits, after the oath or affirmation.

    When you are ready, book an appointment with Minute Notary and have the official form filled in but unsigned. You can swear or affirm it before a notary by video from anywhere in Ontario, or in person on a mobile visit.

Frequently asked

Questions about the Affidavit for Enforcement Request (Form 20P) — Ontario Small Claims Court

01
Who can swear Form 20P?
The plaintiff and creditor, or a representative acting for the creditor. The deponent must be able to swear to the amounts paid and owing.
02
Can I swear it by video?
Yes. The form's own jurat has a version for swearing by video under O. Reg. 431/20, and our notaries can commission it that way from anywhere in Ontario.
03
What interest rate do I use after judgment?
Use the rate stated in your judgment. If you are unsure, ask the court office or a lawyer or paralegal; the notary does not calculate interest.
04
Do I need a separate affidavit for each enforcement step?
No. The court form lets you tick more than one process on the same affidavit, as long as each one's details are filled in.
05
Which other Small Claims forms are related?
Form 8A is the affidavit of service, and Form 15A is the notice of motion and supporting affidavit. Both have their own pages in our template library.
