Only half of Form 15A is sworn
This is the detail that trips people up. Form 15A is one document doing two jobs: the notice of motion, which you simply sign, and the supporting affidavit, which must be sworn or affirmed before a commissioner. The jurat sits under the affidavit half only.
So at the appointment the notary commissions the affidavit portion. The notice portion needs no oath — but fill it in before you attend, because the sworn evidence has to match what you are asking for.

Writing the affidavit half
An affidavit is evidence, not argument. Set out facts in short numbered paragraphs, in the order they happened, and attach anything you refer to as an exhibit. Leave out what you think the other side intended and what you would like the judge to conclude.
Where you did not witness something yourself, say so and name your source — the form of words is that you believe it to be true on information received. Each exhibit endorsed at the appointment is stamped separately, so a motion with several exhibits costs more than a single seal.

- Do I swear the whole of Form 15A?
- No. Only the supporting affidavit is sworn. The notice of motion above it is signed, not sworn.
- Can I attach documents to it?
- Yes, as exhibits. The notary endorses and stamps each exhibit separately, so each one counts as an additional seal.
- Can it be sworn online?
- Yes, over secure video under O. Reg. 431/20. Confirm the court's current practice on remotely commissioned affidavits before filing.
- Can the notary tell me whether my motion will succeed?
- No. A notary commissions the affidavit and verifies your identity. Advice on the motion itself is for a lawyer or paralegal.
