  1. 01

    What is a Small Claims Court affidavit (Form 15B)?

    It is your sworn statement of facts, in numbered paragraphs under the claim's heading. On its own it asks the court for nothing: it is evidence that supports, or answers, another step in the case.

    If you are bringing a motion yourself, the rules require Form 15A, which joins the notice of motion and its supporting affidavit (rule 15.01 (1)). Form 15B is the affidavit that stands alone.

  2. 02

    When you need one

    The rules call for an affidavit, and so allow Form 15B, in situations such as:

    • answering a motion: serve your affidavit on every party who filed a claim or defence and file it, with proof of service, at least two days before the hearing (rule 15.01 (4));
    • adding evidence to your own motion with a supplementary affidavit, served and filed at least two days before the hearing (rule 15.01 (5));
    • swearing that a defendant missed payments under a terms-of-payment order, with the amount paid and the balance, so the clerk can sign judgment (rule 9.03 (7));
    • proving your case by affidavit at the trial of an undefended action, unless the judge orders otherwise (rule 18.01).
  3. 03

    What to include

    Keep it to facts, one per paragraph:

    • The claim number, the court location, and the parties as they appear on the claim.
    • What the affidavit relates to: the motion, request or step it supports.
    • Numbered paragraphs, each holding one fact, in an order that tells the story.
    • For any fact someone else told you, that person's name and a statement that you believe it.
    • Any exhibits, each labelled with a letter and mentioned in your paragraphs.
    • Extra pages, attached and initialled, if the form runs out of room.
  4. 04

    Official source and who accepts it

    The Small Claims Court accepts its prescribed Form 15B. Download the current revision from Ontario Court Services, copy your prepared paragraphs onto it, and swear it before a commissioner or notary. Its jurat has versions for swearing in person or by video under O. Reg. 431/20.

    The form closes with a warning that knowingly swearing or affirming a false affidavit is an offence under the Criminal Code. Read every paragraph before the appointment.

  5. 05

    Common mistakes

    Watch for these:

    • Using Form 15B to bring a motion. A motion, including one to set aside a noting in default or a default judgment under rule 11.06, is made on Form 15A.
    • Putting several facts, or arguments, in one paragraph.
    • Repeating what someone told you without naming them and saying that you believe it.
    • Serving or filing an answer to a motion later than two days before the hearing.
    • Attaching documents that none of your paragraphs mention.

    How to get it notarized in Ontario

    Fill in the form on this page to prepare your wording, then copy it onto the official form. Do not sign it yet: an affidavit or statutory declaration is signed in front of a notary public or commissioner for taking affidavits, after the oath or affirmation.

    When you are ready, book an appointment with Minute Notary and have the official form filled in but unsigned. You can swear or affirm it before a notary by video from anywhere in Ontario, or in person on a mobile visit.

Frequently asked

Questions about the Affidavit (Form 15B) — Ontario Small Claims Court

01
What is the difference between Form 15A and Form 15B?
Form 15A is a notice of motion with its supporting affidavit: you use it to ask the court for an order. Form 15B is an affidavit on its own, used to answer a motion or to give evidence wherever the rules call for an affidavit.
02
Can I swear it by video?
Yes. The form's own jurat has versions for swearing by video under O. Reg. 431/20, and our notaries can commission it that way from anywhere in Ontario.
03
How are exhibits handled?
Label each document with its letter and mention it in your paragraphs. The notary marks and signs each exhibit when commissioning the affidavit, so bring every exhibit to the appointment.
04
What if I need more room?
Attach extra pages to the form and initial each one, as the form instructs.
05
When do I serve and file it?
If it answers a motion, serve it on every party who has filed a claim or defence and file it with proof of service at least two days before the hearing (rule 15.01 (4)).
06
Which related forms have pages here?
Form 15A, the notice of motion and supporting affidavit, and Form 8A, the affidavit of service you can use to prove you served your affidavit.
