A Bill of Sale for a Boat is a written record of a private sale or transfer of a watercraft between two parties. It identifies the buyer, the seller, the vessel (make, model, year, colour, hull identification number), the sale price, and the payment method.
In a private transaction it is the primary proof that ownership changed hands. It is used for powerboats, sailboats, personal watercraft (jet skis), fishing boats, cabin cruisers, and other pleasure craft.
Any time a boat changes hands privately, a bill of sale protects both parties. It is especially important in the following situations.
Our template captures everything needed to document a private boat sale in Ontario. You fill in both parties' details and the vessel specifications in one sitting.
In Canada, pleasure craft with engines totalling 10 horsepower (7.5 kW) or more must hold a valid Pleasure Craft Licence (PCL) issued by Transport Canada. When you buy a used boat that already has a PCL, you need to transfer it into your name within a reasonable time. Transport Canada will ask for proof of purchase, and a properly completed bill of sale serves that purpose.
Boats that are officially registered under the Canada Shipping Act (typically commercial vessels or those with a marine mortgage) use a different process through the Vessel Registry.
No, it is not a legal requirement in Ontario. However, many buyers and sellers choose to have it notarized because a sealed copy provides stronger evidence of the transaction for insurance claims, financing applications, or ownership disputes down the road.
Notarization is also useful when the boat has no PCL or HIN (older or homemade craft), because it creates an independent record of the sale that carries the notary's seal and signature.
Ideally both buyer and seller attend so the notary can verify both identities and witness both signatures. If only one party can attend, that person can swear a statutory declaration confirming the details of the sale instead.
Ontario's Retail Sales Tax or the federal portion of HST generally applies to private sales of certain vessels. The amount and process depend on the type and value of the craft. Keep the bill of sale as your tax receipt and proof of the declared price.
If you are unsure whether tax applies to your specific transaction, check with the Ontario Ministry of Finance or a tax adviser before completing the sale.
