Who signs it, and where it goes
Both partners sign the same IMM 5409, so book one appointment and attend together — on the same video call or on one mobile visit. The commissioner completes a single jurat covering both signatures, and the fee is two stamps: $24.95 for each partner, plus HST. If you cannot attend together, tell us when you book so the declaration is handled correctly rather than commissioned twice.
The declaration is filed with the sponsorship or permanent residence application as part of the relationship evidence, where IRCC’s document checklist for common-law partners lists it. It never stands alone: include proof of at least 12 months of continuous cohabitation, such as a joint lease or mortgage, shared utility bills, joint accounts, and insurance or benefits naming each other. IRCC decides the application; the declaration only records what you both swear to be true.
