Overview
About this document
- 01
What a horse bill of sale should include
Besides both parties' full names and addresses, the price, how it was paid and the date of sale, describe the horse well enough that nobody could mistake it for another:
- Its barn name and registered name.
- Its breed, sex, colour and markings, and the year it was foaled.
- Its breed registry and registration number, and any microchip number.
- The papers, tack or equipment that go with it.
- 02
Registration papers and Equestrian Canada
If the horse is registered with a breed association, the papers and any transfer form go to the buyer, and the transfer follows that association's rules. Equestrian Canada records ownership for competition in the new owner's MyEC account, and says that record is not a legal document. The bill of sale is what shows the sale itself.
- 03
Before you pay
Ontario suggests a lien search on the Personal Property Security Registration system before you buy used goods. A pre-purchase exam by a veterinarian of the buyer's choice is common; the template's as-is term records that the buyer had that chance.
Ontario's Livestock Community Sales Act licenses the public auction facilities where horses are sold; it does not cover a private sale between two people.
- 04
Sales tax on a horse
Ontario's retail sales tax on private sales applies to specified vehicles, such as cars, motorcycles and trailers, and a horse is not one. If the seller is registered for GST/HST, for example a farm or stable that sells horses as a business, HST may apply, and the template has a place to record it.
- 05
Having a horse bill of sale sworn
A private horse sale has no registry step at ServiceOntario, so the bill of sale is a record between the two of you.
If the buyer, the seller or a lender wants it sworn, leave the PDF unsigned: it ends with a solemn declaration that a commissioner can take online by video, under Ontario's remote commissioning rules (O. Reg. 431/20).
If you want a notary to witness the signatures instead, that is done in person, on a mobile visit where the notary comes to you anywhere in Ontario. Bring valid government-issued photo identification either way.

Frequently asked
Questions about the Horse Bill of Sale (Ontario)
- Do I need a bill of sale to sell a horse in Ontario?
- It is the record both of you keep. A horse has no ServiceOntario permit, so the bill of sale shows who sold the horse, to whom, for how much and on what terms.
- What should a horse bill of sale include?
- The names and addresses of both parties; the horse's name, breed, sex, colour, markings and year foaled; any registration or microchip number; the price, payment and date; and the papers and tack that go with the horse.
- Does a horse bill of sale transfer the registration papers?
- It records the sale. The papers and any transfer form go to the buyer, and the breed registry's own rules apply. Equestrian Canada's ownership record is for competition only and is not a legal document.
- Is there sales tax on a horse bought privately in Ontario?
- Ontario's retail sales tax on private sales applies to specified vehicles, not horses. HST may apply when the seller is registered for GST/HST.
- Does a horse bill of sale need to be notarized?
- No. It stays between the two of you. A sworn declaration is optional, for a buyer or seller who wants one.
- Can I fill in a horse bill of sale online?
- Yes. Type the details into the form on this page, then download the PDF and print it for signing.
