What is a gift of funds declaration?
A gift of funds declaration, or mortgage gift letter, is a sworn statement by the person giving the money (the donor) confirming that the funds are a true gift and that no repayment, interest, or stake in the property is expected in return.
Lenders ask for it so they can be sure the down payment is not a hidden loan that would affect your ability to carry the mortgage. The donor usually swears it before a notary public or commissioner for taking affidavits.

When you need a gift letter
A sworn gift of funds declaration is commonly requested in financing and immigration contexts.
- A family member is gifting part or all of a home down payment.
- Your mortgage lender or broker requires written, signed proof the funds are a gift.
- You must show the source of funds for an account opening or large deposit.
- An immigration application requires proof that settlement funds were gifted.

What a gift of funds declaration should state
A complete gift letter names the donor and the recipient and their relationship, the exact gift amount, the date the funds were or will be transferred, and a clear statement that the money is a gift with no obligation to repay it.
Many lenders also want confirmation that the donor is an immediate family member; check your lender’s exact wording, because some require their own gift letter form in addition to a sworn declaration.

How to notarize a gift of funds declaration in Ontario
Once you have filled in your gift of funds declaration and downloaded the PDF, do not sign it yet. An affidavit or statutory declaration must be signed in the presence of a notary public or a commissioner for taking affidavits, who administers your oath or solemn affirmation before you sign.
