About this document

What is a declaration of gift?
A declaration of gift — also called a gift affidavit or declaration of outright gift — confirms under oath that a transfer of money or property is a gift, given freely with no expectation of repayment and no interest retained by the giver.
It documents the gift for the recipient, a lender, or an institution that needs reassurance the money or property was not a loan.
- 02
When you might need one
It is used to record a genuine gift between individuals.
- Giving money or property and confirming it is an outright gift.
- A recipient must show that funds were a gift, not a debt.
- An institution asks for sworn confirmation of a gift.
- 03
Gift declaration vs a mortgage gift letter
This is a general gift of money or property. A gift specifically for a home down payment usually uses a gift of funds declaration with wording your mortgage lender expects, so use that template for a mortgage gift.
Gifts can have tax considerations depending on what is given; this declaration confirms the gift itself, and a tax advisor can address your specific situation.

How to notarize a declaration of gift in Ontario
After you fill in your declaration of gift and download the PDF, do not sign it in advance. A sworn document must be signed in front of a notary public or commissioner for taking affidavits, who administers your oath or solemn affirmation first.
Minute Notary commissions your declaration of gift online by secure video, under Ontario's remote commissioning rules (O. Reg. 431/20), or in person in Ottawa. Bring valid government-issued photo identification so we can verify your identity before applying the notary seal.
