Overview

When you might need one

Family documents split into two kinds. Court affidavits — parenting, support, service, and divorce forms — must be on the form the court prescribes, sworn by the person with first-hand knowledge, and filed with the court office the rule names. Declarations of relationship — common-law status for IRCC, a pension, or a benefit — are declared on the receiving body’s form or a template like the ones here, and go straight to that body.

A notary commissions the oath or declaration and certifies copies; a notary does not advise on what the affidavit should say or whether it will win the point. For a contested family matter, have a lawyer or a licensed paralegal review the wording before it is sworn. Both partners in a common-law declaration each sign before a commissioner, and each brings their own ID.
