Wills, estates & power of attorney

Documents about who decides for you, and about an estate: powers of attorney and their revocation, a codicil to a will, the affidavit of execution a witness swears, and the declarations a bank or the Superior Court of Justice wants before releasing an account or appointing an estate trustee. A power of attorney, a will or a codicil is signed before two witnesses, in person; the estate affidavits are commissioned online.

Overview

When you might need one

A continuing power of attorney for property and a power of attorney for personal care are the two Ontario instruments under the Substitute Decisions Act, 1992, and each — like a will or a codicil — must be signed before two adult witnesses; the attorney, the attorney's spouse or partner, your own spouse or partner, your children and anyone under 18 cannot witness. That is why these are signed in person: the notary comes to you at home, at work or at a hospital bedside, and can provide an additional witness on request (an additional charge applies).

The affidavits around an estate — the affidavit of execution a witness swears so the will can be proved, declarations of next of kin, intestacy, survivorship or a small estate — are ordinary sworn documents and are commissioned online by video under O. Reg. 431/20. The court and the bank set the forms and the thresholds; a notary commissions the oath and certifies copies of the will and the death certificate, and does not advise on who should apply or who inherits. Ask an estates lawyer before relying on any of these on a contested file.

  • 01Appointing someone to make property or personal-care decisions for you, or revoking that appointment
  • 02Swearing an affidavit of execution for a will already signed, or declaring next of kin or a small estate
  • 03Amending a will with a codicil, signed before two witnesses
