Overview

When you might need one

A home generates sworn paperwork at three moments: when you buy (the Ministry of Finance's land transfer tax refund affidavit for a first-time purchaser, usually sworn at closing), while you live there (a declaration of occupancy, residence or rent paid for a lender, a school board, a benefit office or a social-housing provider), and when something has to be proven about ownership. Where the ministry or the housing provider prescribes a form, that form governs; the templates here prepare the facts and cover the cases with no official form.

All of these are statutory declarations or affidavits, so they are commissioned online by video under O. Reg. 431/20 or in person, with government photo ID and the document the declaration refers to — the deed, the lease, the notice of assessment. A real-estate closing itself is different: the transfer, the mortgage and a spouse's consent are signed with the lawyer handling the deal, and a notary witnesses those signatures in person only when that lawyer asks.

  • 01Declaring a property your principal residence for a lender, a tax office or an insurer
  • 02Confirming where you live, or that a tenant lives there, for a landlord, a school or a benefit office
  • 03Claiming the first-time home buyer land transfer tax refund, or declaring income for rent-geared-to-income housing
