Statutory declarationsOverview
When you might need one
A financial institution asks for a sworn statement when a document it relies on is missing or a fact cannot be verified from records. Many have their own form — a bank's lost-draft indemnity, an insurer's proof-of-loss form, a pension administrator's life certificate — and that form governs when it exists. The templates here cover the same ground for an institution that accepts a general affidavit or statutory declaration, and they say which facts the receiving office usually wants on the record.
These are affidavits and statutory declarations, so they are commissioned online by video under O. Reg. 431/20 or in person, with government photo ID. A certificate of independent legal advice is different: it is signed by the lawyer who gave the advice, and a notary can certify a copy but cannot sign it. A promissory note or a loan agreement is a signed contract, witnessed in person when the lender wants a witness.
