Family court, divorce & agreements
Sworn forms for an Ontario family court file — parenting, divorce, service, adoption — and the two agreements couples sign to settle or set out their affairs. The court prescribes most of these, so the wording and the filing rules come from the Family Law Rules, not from us.

When you might need one
Court affidavits must be on the form the Family Law Rules prescribe, sworn by the person with first-hand knowledge, and filed with the court office named in the rule. Our pages prepare the facts and the wording so the sworn version is ready in one sitting; the court still receives its own form. A separation agreement or a cohabitation agreement is a domestic contract under the Family Law Act: it is signed, witnessed and dated, each side should have independent legal advice, and it is not sworn.
A notary commissions the affidavit or statutory declaration and certifies copies; a notary does not advise on what the affidavit should say or whether it will win the point. For a contested matter, have a lawyer or a licensed paralegal review the wording before it is sworn. Both partners signing an agreement attend in person with ID, because a witnessed signature cannot be taken by video.
